SEQURA APPLICATION TERMS OF USE

Welcome to SeQura. These Terms of Use (the "Terms") regulate the access and use of the application (the "App") of SeQura Worldwide, S.A. ("SeQura" or "We").

The SeQura App is accessible via mobile devices and is available for download through Google Play (Android) and the App Store (Apple).

These Terms do not apply to SeQura's financing terms or payment conditions when you decide to finance one of your purchases in installments with Us. This financing is governed by its own General Contract Terms.

By downloading, accessing, or using the App or by registering as a User of the App, you are accepting these Terms and our Privacy Policy, which explains the processing of your personal data. If you do not agree, please do not use the SeQura application.

SeQura may modify these Terms in accordance with the provisions herein.

1. WHO IS SEQURA AND HOW CAN YOU CONTACT US?

SeQura Worldwide, S.A., is a Spanish company with registered office at Calle Alí Bei, 7-9, Entresuelo, 08010-Barcelona, Spain, provided with NIF A-66054164 and duly registered in the Mercantile Registry of Barcelona under I.R.U.S. 1000368139679 and page number B-439545.

2. HOW DO I REGISTER AND SIGN UP AS AN APP USER?

For you to access the App, it will be necessary for you to register as a user. Don't worry, to register, you don't need to have bought or paid in installments with SeQura before.

To register as a User, you must be a resident in Spain, be over 18 years old, and identify yourself correctly. To do this, you will only have to provide us with the following personal data:

Your personal phone number and your identification number will be the reference indicator to identify you as a User in the App.

Once identified, we will ask you to configure your 6-digit PIN through which you can access your account. The PIN is secret, personal, and non-transferable. If you forget your PIN or believe someone may have stolen it, contact us or change it by following the instructions detailed below.

Registration in the App is an easy and simple process. As soon as you have registered, you will acquire the status of "User" of the App and from then on you can also start benefiting from our rewards.

In some cases, access to the App may also be done with special credentials, one-time codes (OTP) sent to your mobile, PIN keys, and, if your device allows it and this functionality is compatible, by fingerprint or facial recognition (Face ID).

For some programs offered by SeQura or for some special App functionalities (which do not necessarily involve the provision of financial services), we may ask you to configure a security PIN to verify your identity so that you can authorize orders and carry out authorizations through the App. Remember, this PIN is personal and non-transferable and you can change it from your profile or contact us. Always keep your keys, passwords, PIN, and your device secure at all times. Remember that your account is personal and non-transferable.

Your account will remain logged in so you don't have to authenticate every time you use the App, unless the session has been closed, where you will have to re-enter your details.

3. VERIFICATION OF YOUR IDENTITY

In compliance with Law 10/2010, of April 28, on the prevention of money laundering and the financing of terrorism ("Law 10/2010"), SeQura may request additional information or documentation from you when:

If you do not provide the required information or the result is not satisfactory, we may limit or temporarily suspend certain functionalities (e.g., cashback redemption, opening loot boxes or using your rewards) until the necessary checks are completed. In some cases, we may block your account and access to the SeQura App.

4. THE SEQURA APPLICATION: FEATURES AND FUNCTIONALITIES

At SeQura, we always want to offer you the best shopping experience and the possibility of searching for a wide range of stores. We may not have a commercial relationship with all the stores shown or those that appear when searching in the SeQura App. In these cases, SeQura acts as a **web browser or search engine**, redirecting you to the store's website in the web browser with an integrated experience in the App. Remember, even if you can see it within the App, it is the same website as the final merchant.

In some cases, you will also see that some merchants allow financing their purchases by applying SeQura's flexible payment solutions.

The App functions as a store directory, where you can search for stores and make your purchases, get an overview of your purchases, receive advice and much more.

The App also functions as a shopping assistant, so you can find the product you are looking for more quickly.

The exact content of the App's functionalities may vary from time to time, but below we indicate some of the most relevant features:

The SeQura App may also present promotional content from merchants. Promoted content may be a nod we make to merchants who offer flexible payment solutions with SeQura, but in this version, we do not advertise or charge commissions from merchants for this activity. We may present text, an image, a video, links to a related website chosen by SeQura, etc., but the control and content will always be decided by SeQura.

At SeQura, we work to offer you new things and improve its functionalities. Therefore, the services that are finally made available to you may vary depending on the App's update. We will notify you of new versions, so you can update it, and we recommend that you always have it updated to the latest available version.

Remember that, as usual, internet access and data costs from your operator are at your expense.

5. PERSONALIZATION OF YOUR PROFILE AND MEMORIZATION OF THE PAYMENT CARD

For you to enjoy the full potential of the App and benefit from all its functionalities, we will ask you to configure and personalize your profile to your liking. In this process, you can choose your favorite shopping categories, mark the stores you like the most or the stores where you usually make your purchases, etc.

Once your account is configured, we will show you the merchants' stores that interest you the most or that may fit best according to the preferences you have chosen in the profile settings.

To give you the best possible User experience, when you make a purchase with SeQura, you can use different payment options. If you decide to pay with SeQura, we will keep your payment details until you decide to delete them or until you close your SeQura user account. By saving your payment information with SeQura, you agree that SeQura will charge subsequent purchases with SeQura to the saved payment card. This way, you won't have to add it every time. It will not be charged until you make the purchase. If the default payment card you have chosen cannot be charged for a specific purchase, including plans or subscriptions, you agree that SeQura will try to charge your payments to another card you have registered in your User account of the App.

6. SEQURA PRIME

SeQura is adhered to different affiliate programs and also has its own affiliate program (collectively, referred to as "SeQura Prime"). This means that when you shop at affiliated merchants (the "Affiliates" or "Affiliated Merchants") by accessing through the affiliate links, SeQura may receive a sales commission. SeQura uses a part of these commissions to give its Users Qoins (points of our Rewards Program as we explain in more detail in the following section), prizes you will find in surprise boxes (loot boxes), raffles, rewards and cashback, etc.

The Affiliated Merchants to the SeQura Prime program are chosen at the exclusive discretion of SeQura and may vary from time to time.

Please note that the purchases you make at Affiliated Merchants will be directly with them and not with SeQura. This means that the Affiliated Merchants will be solely responsible for their website and the content published on it, including intellectual and industrial property rights and the protection of your data and your rights as a consumer. SeQura has no control over the websites of the merchants, whether Affiliated merchants or not. SeQura does not validate or verify their content, nor does it make any statement about its legality and is not responsible for any breach and/or damage you may experience when making your purchase at those merchants or Affiliates.

7. YOUR CASHBACK WITH SEQURA: QOINS AND THE REWARDS PROGRAM

Through our Rewards Program, SeQura wants to reward your loyalty when you make your purchases through the App or when you finance your purchases by applying the flexible payment solutions offered by SeQura.

The "Qoins" are the points of the SeQura Rewards Program, which reflect the value proposition of your activity within the App. Think of Qoins as your rewards balance within SeQura. They are not money, nor crypto assets, nor a digital asset or a means of payment, nor are they electronic money. Qoins are SeQura points that help us convert your activity in the App into real advantages for you.

When we talk about "cashback", we mean that by shopping with SeQura, you also win. As you can see, in many of the purchases you make through the App, you can earn cashback. Above the merchant logos, you will see what cashback you can earn with each purchase. Remember that it may vary depending on the merchant and even with each purchase.

Qoins, cashback, and the different rewards you can earn with SeQura are governed by their own terms and conditions (the "Rewards Program Terms") which you can consult at the following link: https://legal.sequra.com/rewards-conditions. The Rewards Program Terms complement these Terms and you must accept them to participate and benefit from our rewards.

In accordance with the provisions of the Rewards Program Terms, you choose how and when to redeem your Qoins, easily, transparently, and always within the SeQura ecosystem. This way, you can choose how to enjoy your Qoins and decide if you want:

It is very important that you know that for SeQura to be able to correctly track and assign your cashback, you must keep cookies and/or equivalent technical identifiers activated (e.g., cookies, browser storage, device identifiers, and JavaScript by TUNE) during browsing and purchases associated with the Rewards Program. If you disable these technologies and/or there are technical frictions, we may not be able to track your activity and the cashback you expected to receive with your purchase may not be correctly assigned and you may not see your balance updated in the App. This processing is carried out in accordance with our Privacy Policy and in accordance with the Rewards Program Terms. You can manage your preferences in the App and in your device settings.

SeQura will not grant rewards to users for those purchases made using payment methods or forms offered by SeQura's competitors.

8. SEQURA TRAVEL

In the App, you will find a travel section "SeQura Travel" or "Travel" where you can discover and book tourism services (hotels and flights) offered by independent third parties unrelated to SeQura (each, a "Travel Provider"), such as, for example, online travel agencies or specialized platforms, etc.

What role does SeQura play in the Travel section?

SeQura does not organize, sell, or intermediate tourism services and does not act as a travel agency, package tour organizer, distributor, or intermediary. SeQura provides you with a digital environment to facilitate access, through an integrated (in-app) experience, to offers and content published and managed exclusively by the Travel Providers. All bookings, tourism service contracts, modifications, cancellations, refunds, and any incidents related to your travel experience are entered into and managed directly between you and the Travel Provider. In no case will your travel contract be formalized with SeQura.

Who operates the browsing experience?

The site https://sequra.travel/ and your in-app Travel experience, the search engines, listings, and travel selection processes are operated by our partner, Rewardwave, S.L., with registered office at Gran Vía de Don Diego de Haro, 1, 48001, Bilbao (Bizkaia) and provided with NIF B-13681606 ("RewardWave"), who acts as a technology provider and technical intermediary.

RewardWave is responsible for the information contained on the page https://sequra.travel/ and displayed in the App's "Travel" section and for the correct functioning of the browsing experience until redirection to the Travel Provider's purchase page (such as lastminute.com). When you browse the Travel section or the sequra.travel website or complete the purchase with a Travel Provider through the App, you will be in a third-party environment subject to their terms and conditions, their privacy policy, and cookie policy.

Identification of the Travel Provider and applicable conditions

Before confirming any reservation, we will do everything possible so that the identity of the **Travel Provider** with whom you are going to contract (including its corporate name and contact details), as well as links to its terms and conditions, privacy policy, and cancellation policy, are clearly and visibly displayed in the third party's browser responsible for the journey's navigation at all times. Be sure to review them carefully, as they will govern your reservation and any changes, cancellations, or refunds.

Responsibilities

To the maximum extent permitted by law, SeQura will not be liable for delays, cancellations, errors, unavailability, content inaccuracies, contractual breaches, or damages arising from tourism services provided by third parties, nor for the navigation and content operated by RewardWave or by the Travel Providers or their partners and collaborators.

Financing with SeQura (if offered at the Travel Provider's checkout)

In some cases, the Travel Provider may offer you the possibility of financing your purchase using the flexible payment solutions offered by SeQura. If you choose to finance your purchase with SeQura:

Payments to the Travel Provider

If you pay the Travel Provider without SeQura financing, the Travel Provider acts as the merchant of record, meaning they are the one who appears as the merchant in the payment charge and they are the one who assumes ownership of the transaction with you and the payment provider. The price and collection are determined and managed exclusively by the Travel Provider under their own conditions; SeQura does not intervene in the price setting process, discounts, supplements, or tariff policies. SeQura does not apply surcharges for the use of the Travel section.

As part of its commercial collaboration with RewardWave, SeQura receives compensation for sales regardless of the payment method you ultimately use. This does not alter the price you pay or the conditions of the tourism service, and SeQura does not participate in the formation of prices or the commercial decisions of the Travel Provider. The presentation of offers does not imply recommendation, verification, or certification by SeQura.

Your Cashback on SeQura Travel

When you book your trips (hotels and flights) through the App in the “SeQura Travel” section, you can earn cashback. Cashback is governed by the same rules as our Rewards Program, and specific particularities apply as set out in the Rewards Program Terms.

In Travel, you will only receive cashback for purchases made in a single card payment. Purchases financed in instalments with SeQura will not generate cashback, nor will purchases made through the sequra.travel website. When you make a single payment with your payment card, your cashback will appear as available on the same date you take the trip, once the operational timeframes have been met.

All other rules (how we calculate cashback, verification, and any potential adjustments due to cancellations or changes) follow the rules of our Rewards Program, which complement this section and which you must accept in order to benefit from cashback in SeQura Travel. Privacy and data use in Travel

Important Reminder

The offers shown in the Travel section are provided and updated by the Travel Providers. SeQura does not collect, combine, or organize travel services, nor does it determine their price, availability, conditions, itineraries, or coverages. Customer service and the management of incidents related to your trip must be addressed to the Travel Provider's channels indicated by them. SeQura can only help you in relation to your financing, if you had chosen to pay in installments with us for your purchase.

9. DOES IT COST ANYTHING?

No. The use of the App and its functionalities will be free, unless expressly indicated otherwise. Remember that if you decide to finance your purchases by applying SeQura's flexible payment solutions, their own terms and conditions will apply and interest and fees may be charged. Be sure to check the information indicated for the payment method you have chosen.

The App is a free digital service and the legal right of withdrawal does not apply to these Terms, without prejudice to you being able to uninstall the App or close your account at any time.

10. SECURITY OF YOUR ACCOUNT AND THE APP

Security is very important for SeQura. To protect the App, we may apply technical measures, we may request an additional verification process, or we may even temporarily block your access to the App if we detect risks or anomalous behaviour.

You are responsible for the correct safekeeping of your device and the use of your account. Do not share your credentials, OTP, passwords, or PIN with third parties. If you suspect unauthorized access, notify us immediately.

11. INTELLECTUAL PROPERTY AND LICENSE OF USE

The App, its contents, trademarks, logos, code, and designs are the exclusive property of SeQura or third-party licensors. SeQura grants you a personal, limited, non-exclusive, non-transferable, and non-sublicensable right of use to use our App on your devices in accordance with these Terms. It is strictly forbidden to copy, modify, decompile, reverse engineer, distribute, or create derivative works of the App, except as permitted by law.

Any unauthorized use may lead to the suspension of the account and the corresponding actions.

12. ACCEPTABLE USE AND USER OBLIGATIONS

By registering as a User and using the App, you expressly agree to:

The use of the contents and access to the App are your sole and exclusive responsibility and by accepting these Terms, you undertake not to carry out any conduct that could damage the image, interests, and rights of SeQura, the rest of its users, or that prevents in any way, the normal and adequate use of the App. The use of information that does not belong to you or that you are not authorized to use, or the use of the App in a manner that does not comply with these Terms, will be considered misuse.

The contents you will see in the App are managed exclusively by SeQura. At SeQura, we can remove content, limit functionalities at any time, and/or suspend the account or block your access if we believe or have suspicions that you have breached these Terms or that you may be committing fraud with it.

13. ACCOUNT CLOSURE AND SUSPENSION

You can close your account at any time from your profile or by contacting Us through the channels detailed in section 1 of these Terms. We may also suspend or close your account if:

The closure of your account does not imply the refund or conversion of unused Qoins. For more information and to see how to redeem them before closing your account, consult the Rewards Program Terms.

14. FRAUD

SeQura reserves the right to initiate as many actions as it deems appropriate in case of detecting fraudulent behaviour or behaviour suspected of being so by the Affiliate who is not making correct use of the App, all its functionalities, Rewards Program, etc.

15. USER CONTENT AND USE LICENSES

If you upload or share content through the App (e.g., reviews or images), you grant us a worldwide, non-exclusive, free, transferable, and sublicensable license to use, reproduce, transform, and analyze said content for the sole purpose of providing, maintaining, improving the App and our Rewards Program, and for preventing fraud, always in accordance with our Privacy Policy. You are solely responsible for having the necessary rights over the content you upload and ensuring that it does not infringe the law or third-party rights.

16. ELECTRONIC COMMUNICATIONS AND NOTIFICATIONS

Through the SeQura App, we will send you messages, notifications, or reminders related to the App's use service, support, administration, or information that you have previously requested. Likewise, we may send you notifications about offers available in the App.

We may send you notifications through different means (e.g., email, SMS, push notifications, or messages within the App). Some notifications are necessary to provide you with the App access service (operational or security). You can manage your application notification preferences from your device's settings menu.

17. PRIVACY AND DATA PROTECTION

SeQura is the data controller of your personal data. By registering in our App, we will process your data for the following purposes which, in turn, have the legitimizing bases for processing detailed below:

  1. Manage your registration, access, and use of the App, provide its functionalities, guarantee security, prevent fraud, processing that we carry out to enable the execution of the contractual relationship for the provision of our credit, payment services, or the App's own functionalities.
  2. To comply with our AML/CFT obligations, for the application of anti-fraud measures, or for the redemption of rewards or cashback, including the sending of Bitcoin (in collaboration with authorized third parties), we will be complying with legal obligations. We may request your consent to process additional information, specifically biometric data.
  3. To personalize App notifications, if you grant us your consent. This processing would be carried out using device identifiers and a software development kit or SDK (technologies equivalent to a cookie that records and stores data on your device). You can withdraw your consent at any time from the App settings.
  4. To personalize your User experience in relation to the services provided by SeQura, such as preferentially showing you in the App the merchants that best fit your profile. For this, the App may use device identifiers and SDK (cookie-equivalent technologies) for security, operation, personalization, and analytical purposes. You can manage or withdraw your consent from the App or your device settings. Disabling these options may affect some App functionalities (e.g., the cashback service with SeQura Prime).
  5. When we use providers for authentication or biometric verification within the App, they will act as data processors, with the corresponding contract and with adequate security measures.
  6. We use third-party services that provide us with services (among others, hosting, maintenance, analytics, support, identity verification, anti-fraud, messaging, autocompletion, and payments) with whom we have signed the corresponding data processing agreements, in which we have included the due guarantees of security and confidentiality. In specific App functionalities, it will be necessary to communicate data to third-party data controllers (e.g., participating merchants, verification entities, or authorized crypto asset service providers in relation to the bitcoin cashback program). If there are international transfers outside the European Economic Area (EEA), they will always be under the application of adequate safeguards (such as European Commission adequacy decisions or standard contractual clauses) as required by the GDPR.

Access to your device camera and files

In the event that you have to share any file with SeQura, such as the photograph of your identity document (DNI/NIE) and other files, you can use the App's functionality that allows you to upload images or files already saved on your device or activate the camera. For this, SeQura will ask you for authorization to allow the App access to this type of content stored on your device. Likewise, in the event that you want to download any document available through your App, SeQura will ask you for this same authorization to download them to your device. SeQura will not access the rest of the information stored on your device, nor will it use the images or files it has access to for purposes other than those mentioned.

Identification through your fingerprint or Face ID

You can access the application by using your fingerprint and/or facial recognition (Face ID). To do this, you must register this functionality on your device. Remember that SeQura will never have access to the biometric data (fingerprint, facial recognition) that you register on your device. SeQura will determine the biometric data that allows access to the App at all times, to be used with the aforementioned biometric data. In case you prefer to access through User and password, it will be saved in an encrypted and unintelligible manner. You can withdraw your consent at any time in your device settings.

We will keep your data as long as your User account exists in the App and, once your User account is closed, during the applicable limitation periods. You can request more information about the processing of your personal data by contacting SeQura's Data Protection Officer through the email address dpo@sequra.es.

You can exercise your rights of access, rectification, deletion, opposition, limitation, and portability, and withdraw your consent, by sending an email to arco@sequra.es. You can also file a complaint with the AEPD (www.aepd.es).

18. THIRD-PARTY LINKS AND THIRD-PARTY SERVICES UNRELATED TO SEQURA

The App is downloaded from third-party stores (Google Play, App Store) that have their own terms. Some functions may rely on third-party services (e.g., maps, OCR, verification, messaging). SeQura does not control these services and is not responsible for their conditions, availability, or policies. We will inform you when applicable.

The App may show or include links (URLs) to third-party sites, content, or services, which are provided solely for your convenience. The inclusion of a link does not imply sponsorship, recommendation, affiliation, or endorsement by SeQura. We recommend reviewing the third parties' terms and policies before using their sites or services. SeQura does not control, approve, or guarantee the content of those third-party URLs and assumes no responsibility for their accuracy, availability, security, or legality. To the maximum extent permitted by law, SeQura will not be liable to you or third parties for claims, damages, or losses derived from: (i) content hosted on third-party URLs; or (ii) eventual breaches attributable to said third parties regarding intellectual property, privacy and data protection, third-party rights, consumer protection, or other similar matters.

19. APPLICATION AVAILABILITY AND UPDATES

We will use our best efforts to keep the App always available and secure. Even so, interruptions may occur due to maintenance, technical incidents, or causes beyond SeQura's control (e.g., network outages, internet saturation, device failures, power outages, cyberattacks, incidents in application stores or external providers), so we cannot guarantee continuous, uninterrupted, or error-free availability of the App.

We may also change, update, or remove functionalities, whenever we deem it necessary. When we make changes, we will notify you in accordance with these Terms. In cases of force majeure or circumstances outside our reasonable control, SeQura will not be responsible for delays, errors, or unavailability that occur, without prejudice to your rights as a consumer.

When we launch an update, we recommend that you accept and install the new version of the App since, most of the time, in addition to adding functionalities and improvements, new security measures aimed at protecting you are also included. 

20. LIABILITY

The App is offered "as is" and "as available". We will use our best efforts to ensure that your experience browsing the App is safe and stable, but we do not guarantee that it will be free of errors or interruptions. To the extent permitted by law, SeQura will not be liable for direct or indirect damages or loss of profits derived from the use of the App, failures of third-party networks or platforms, or unfulfilled expectations about promotional content or automatic assignment of rewards. Nothing in the foregoing limits the liabilities that cannot be excluded by law.

We will not be responsible for delays or breaches due to causes outside our reasonable control (force majeure), such as, by way of example, power outages, internet failures, network attacks, generalized failures of providers, natural disasters, strikes, or administrative decisions.

21. CHANGES TO THESE TERMS

We may modify these Terms for legal, technical, security, regulatory reasons, or to reflect changes in the App, add or remove functionalities, etc. In those cases, we will publish the new version of the Terms with reasonable notice when it affects you significantly. Changes that benefit you or that do not have a negative impact may be applied immediately. If you do not accept the changes, you can stop using the App and/or close your account from your profile.

22. ASSIGNMENT AND SUBCONTRACTING

Your account is unique, personal, and non-transferable and you may not assign it to a third party. SeQura may assign this contract to other companies within its group. SeQura may also assign the contract or subcontract services related to the App and its functionalities to trusted third parties, without prejudice to your rights as a consumer and maintaining the guarantees provided in these Terms and in the Privacy Policy.

23. PARTIAL NULLITY AND NON-WAIVER

If any clause of these Terms is declared null or unenforceable, it will be interpreted in a way that most faithfully reflects its purpose and will not affect the validity of the rest. The fact that we do not demand compliance with any right or provision does not imply a waiver of the right to demand it in the future.

24. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law. For any dispute, the courts and tribunals of Barcelona will be competent, without prejudice to the imperative protection that may correspond to you as a consumer.

25. QUESTIONS, COMPLAINTS, CLAIMS: CAN WE HELP YOU?

If you have any questions or need clarification or want to file a complaint, you can contact Us through the channels indicated in point 1 of these Terms. We will do everything possible to try to respond to you within an indicative period of 48–72 working hours.

As a consumer, you can also go to the European Online Dispute Resolution Platform (ODR) to file complaints: search for "ODR European Commission". This route is voluntary and does not limit your right to address the competent consumer authority or courts if you deem it appropriate.
